The Collapse of the 28-Article Peace Proposal for Ukraine: Why Peace Negotiations Continue to Stumble

Europe experienced widespread relief on Monday, as the tension caused by the announcement of a new 28-point plan for ending the war appeared – temporarily – to have been defused. A senior US official spoke of "substantial progress" after bilateral negotiations in Geneva. On Monday night, Moscow made its response: an extensive attack of missile and drone strikes on Kyiv.

The Rhythm of Negotiation and Warfare

The chain of contrasting events captured the bleak nature of the current period. By day, negotiation efforts are conducted: positive announcements are released from different nations. Significant resources is expended on restraining particular approaches. By night, Moscow forcefully demonstrates the world that, for them, conflict continues to be the key method for achieving "peace".

After-Dark Attacks

As Russia's attack progressed into the early hours of Tuesday, the current condition of Ukraine's vulnerability was exposed. Ukraine is capable of detecting missile launches from enemy soil, a ability provided through up-to-date information. From witness perspectives, Ukrainian air force fighter jets that had been deployed to engage hostile aerial threats flew past – advanced fighter aircraft delivered to Ukraine by NATO members.

Soon thereafter, Kyiv's missile defense thundered: several firings targeted at a Russian ballistic missile. This was a sophisticated defense system at work, presumably provided by partner states. Every launch shakes the surroundings, causing tremors. The instant of fear quickly becomes resigned acknowledgment: perhaps the incoming missile won't hit its mark this time, protecting urban areas from catastrophe and further power outages.

Ongoing Risks

Soon after, a large-caliber weapon fired at a unmanned aircraft close by, part of a mobile-fire group – probably Western-made equipment. Regrettably, the bullets missed the hostile drone – it pressed on overhead toward its target.

Periodically, this persisted until dawn. Kyiv faced the early updates: multiple fatalities, damage and heating outages in many homes as a result of the nocturnal offensive. As customarily, everyone still maintained normal activities – enduring hostilities. But those entire period encapsulated Ukraine's essential dependence on international aid – a dependence that European nations are clearly incapable to fill in the short term.

Failed Diplomacy

The detailed framework from Washington sparked intense emotion, discussion and deep concern – and briefly redirected concern from Ukraine's most significant graft case in years. Yet, we have experienced comparable situations, after prior negotiation attempts and bilateral conferences.

Every new approach from Washington follows the consistent cycle: a diplomatic cavalry charge against Ukraine, which Kyiv, with allied governments, manages to fend off. They manage the tension but never actually secure success. This trend will, no doubt, persist.

Political Considerations

It is tempting to accuse particular leaders of consistently pushing Moscow's conditions. But that does not seem to be the entire situation. Washington operates on a premise familiar among seasoned negotiators: you cannot achieve through diplomacy what you have failed to defend militarily. The White House assumes that it is unfeasible to compel Moscow to relinquish the territory that it already controls in Ukraine's southern or eastern regions.

The issue is that while acknowledging this situation, US leadership does little to deter Moscow, through statements or actions, from thinking that the situation will not evolve additionally in its favour in the near future.

Opposing Positions

Therefore, Moscow is certain that duration works to their advantage – that Ukraine and its partners are approaching exhaustion. Their incentive to agree to terms that does not give them the maximum possible gain is almost completely absent. There may be numerous efforts to end hostilities, but they will continue as long as Russia's leadership remains completely certain in the outcome.

On the contrary, Kyiv believes that Ukraine can still persist, progressively conceding lives and land but preventing a entire defensive failure until circumstances change in its benefit.

Present Conditions

Factually, there are no actual prerequisites for a truce. Now, personal considerations are entering the equation: political desires to broker a ceasefire and secure international recognition, and Ukrainian leadership's twin challenges – on one hand, not to estrange crucial supporters, and on the other, to mobilize citizens around the flag against any proposal Kyiv finds unsuitable, so that their attention does not switch to internal issues. And although their task will now be considerably more difficult after recent developments, it remains very improbable that this will change their overall approach.

These opposing factors are influencing discussions.

Assessment and Future

It took a mere seven days to eliminate the 28 points of the current initiative. Forceful and unpredictable management of the matter by US administration, opposition by Ukraine and the remaining European nations, along with soothing efforts of representatives, and finally, current information leaks, all served their function.

While new proposals based on old ideas are imminent, Kyiv, London and other European capitals should arrive at a critical understanding: Ukraine and Europe will only be able to counter political attacks from Washington that are based on Russian demands and demonstrate particular unwillingness to change the course of events, if they remain united and improve their protective measures at a significantly accelerated rate. If they do, neither political nor armed coercion will be able to break them. In the meantime, Ukraine's ability to defend against evening bombardments will, for the coming months, largely rely on sustained allied backing.
